Practice Areas

Employment

The firm has extensive experience representing employers in class actions, representative and individual PAGA claims, as well as individual claims for sexual harassment, gender, race, and national identity discrimination, disability discrimination, as well as in various wage and hour claims. We have also represented employers and employees regarding alleged violations of trade secrets and non-competition agreements. Our lawyers also have extensive experience in proceedings before the EEOC, the DFEH and the California Labor Commissioner.

Iezza & Hockel’s attorneys provide our clients counsel on a wide range of employment issues, including compliance with federal and state employment laws, the drafting of employment policies and handbooks, and the handling of day-to-day employment related issues, such as workplace investigations and employee discipline. In addition, we regularly conduct seminars for the HR departments of our clients.

Appellate

Iezza & Hockel’s attorneys have represented clients in California Courts of Appeal, the California Supreme Court, and the Seventh, Eighth and Ninth Circuits. Our extensive experience has enabled us to successfully defend trial court victories in the appellate courts, and, in some cases, establish new law. Notable successes include: Atalla v. Rite Aid Corp., 89 Cal.App.5th 294 (2023) (employment); Fries v. Rite Aid Corp., 173 Cal.App.4th 182 (2009) (employment); Credit Suisse v. Grunwald, 400 F.3d 1119 (9th Cir. 2005) (FINRA/employment); Citizens to Enforce CEQA v. Rohnert Park, 131 Cal.App.4th 1594 (2005) (land use); O’Connor v. The Clorox Company, Eighth Circuit Docket No. 00-3856 (8th Cir. July 26, 2001) (wrongful termination); Acequia, Inc. v. Prudential Insurance Co., 74 F.Supp.2d 792 (N. D. Ill. 1999), 226 F.3d 798 (7th Cir. 2000) (business tort).

Catastrophic Injury and Wrongful Death

We specialize in representing victims who have suffered catastrophic injuries arising out of motor vehicle, pedestrian, bicycle and motorcycle accidents, and medical malpractice as well as injuries sustained on the premises of others and from defective products.  Our clients include wrongful death heirs and surviving family members. If you or a loved one is seriously injured by the negligent actions of someone else, you may have the opportunity to receive compensation. Our attorneys have decades of experience dealing with personal injury and wrongful death cases. We believe that you shouldn’t have to suffer because of the actions of someone else. Our attorneys vigorously get the compensation you need to move forward and maximize your recovery.

Commercial and Business Litigation

Our attorneys have a wide range of experience in the handling of commercial lease disputes, shareholder derivative actions, construction disputes, business tort disputes and trade secret litigation. Much of our success in this area comes from our careful initial analysis of claims and defenses and, where appropriate, utilizing mediation to resolve disputes efficiently. Nevertheless, we will simultaneously strategize and execute a litigation plan with the aim of successfully trying the case if necessary.

Alternative Dispute Resolution

Most cases of all types settle. This simple fact reflects the time, expense and inherent uncertainty of trials. Our litigation strategy always reflects the dual purposes of preparing a case for trial, and, when and where appropriate, making a case amenable to settlement. All of our attorneys have extensive experience, resolving cases in Early Neutral Evaluation, Mediation, and other alternative dispute processes.

ADA Compliance and Defense

Iezza & Hockel’s attorneys have extensive expertise in handling cases alleging violations of Title III of the Americans with Disabilities Act and the California Unruh Act, which seek statutory damages for alleged violations of the ADA. We believe that having properties inspected by a Certified Access Specialists (CASp) and bringing properties into compliance before a lawsuit is filed is the best way to minimize potential exposure to costly and distracting ADA litigation. Mostly plaintiffs in ADA cases are serial “drive-by” plaintiffs who make a living preying on and extorting money from small business owners. Our experience includes representation of both landlords and tenants in disability access cases involving all types of businesses, including retail, restaurant, hotel/motel and other areas of public accommodation. We also have experience defending website accessibility claims brought by persons with visual disabilities and website content claims brought by persons with mobility disabilities.
